WHAT EXACTLY IS A FEDERAL CASE?

The United States has two distinct and interrelated levels of government, the state and Federal systems. The Federal government is the national government. Each state has its own set of laws, and the Federal government has its own set of laws which sometimes controls state law, sometimes is independent of state law and sometimes interacts with state law. A good example is bank robbery. This is usually a Federal crime because most banks are federally chartered, and affect and involve interstate commerce. Crimes that occur on Federal property are usually dealt within the Federal system. More ordinary crimes like assault and battery or theft, for example, are almost always dealt with through state laws.

WHY ARE FEDERAL CASES SO SERIOUS?

Since the Federal government lets typical crimes be handled by the states, the Federal government, as the national government, deals with crimes that it believes are very serious, and that have a great impact on society at large. While the resources of the Federal government are not unlimited, they typically concentrate as much “legal power” as is necessary to get a conviction, once a decision to prosecute has been made. This could include the FBI or the DEA, or any other government agency that has been involved with an investigation, from the SEC to ICE (customs). Actual cases are usually handled by the United States Attorney’s Office, which are clustered in various major cities throughout the United States.

IS THERE A DIFFERENCE IN THE WAY THE FEDERAL GOVERNMENT PROCEEDS WITH A CASE?

Yes. The Federal government often takes a relatively long time to investigate, indict and arrest someone. Investigations can take years to complete, depending on the complexity of the crime being investigated. An example would be a complicated bank fraud case involving extensive paperwork. The government could bring witnesses before a “grand jury” made up of ordinary citizens where they are asked questions under oath about the possible crime. No one should ever go before a grand jury without consulting an attorney, even if they believe they are an innocent witness or victim. A simple slip of the tongue could make the government think you were criminally involved, even though you were not involved in the crime.

IS FEDERAL COURT DIFFERENT FROM STATE COURT?

Yes. Federal Court tends to be very formal and intimidating. Federal judges must be appointed by the President and approved by the Congress. They are appointed for life unless impeached by the Senate for bad behavior. Rules and procedures are very specialized and strict, and an attorney must be well versed in them to adequately represent a client.
